You must agree to the following licenses as they apply to the respective pipe sources before downloading the Brut-Leuchten Orgel sample set:

Regarding pipe samples from Sonus Paradisi and/or Hauptwerk.cz (Smecno, Daniel Prib):

You should read the following terms and conditions carefully before using the Sonus Paradisi Sample Set. Your use of the Sonus Paradisi Sample Set indicates your full acceptance of this license agreement.

The object of the contract is the Sample Set. The Sample Set is a set of wav files with loop and release markers, containing the sound recording of a given musical instrument. With a help of specialized software (such as Hauptwerk), the sound of the given musical instrument may be faithfully reproduced virtually.

Jiri Zurek, as the licenser, grants to you, the licensee, a non-exclusive personal right to use this Sample Set in accordance with the terms contained in this license.

You may use the sample set on a single computer in non-commercial applications. Copying, lending, leasing, trading, duplication, reselling, hiring, sub-license granting, uploading or downloading to a database, server or network or any other form of distribution of the samples or recordings using the sample sets without identifying them as virtual, are strictly forbidden. If the licensee violates this license considerably, the licenser is authorized to an immediate termination of the contract. Furthermore, the licensee would be obliged to refund to the licenser the lost profit. You may, however, edit the organ definition files and share them freely with the Hauptwerk community.

If you wish to distribute recordings of organ music made with the Sample set, you should ask Jiri Zurek for a written permission. Special regulations may apply.

Jiri Zurek retains ownership of all the sound samples. Jiri Zurek reserves all other rights not expressly granted to you.

If you acquired this product in Czech Republic, this agreement is governed by the Czech laws. If you acquired this product outside Czech Republic, then local law may apply.

Regarding pipe samples from Christian Datzko (Ott-Orgel):

§0 Sinn der Lizenz. Diese Lizenz soll dem Zweck dienen, die Rechte und Pflichten des Lizenznehmers zu regeln. Da sie von einem Laien geschrieben wurde, ist sie wahrscheinlich unvollständig und hält in Teilen juristischen Standards nicht stand. Daher ist diese Lizenz dem Sinne nach zu verstehen. Dem Lizenznehmer werden Rechte eingeräumt, die teilweise Pflichten nach sich ziehen. Ob der Lizenznehmer diese Rechte wahrnimmt, ist ihm selbst überlassen, wenn er diese Lizenz oder Teile daraus ablehnt, darf er jedoch keine dieser Rechte wahrnehmen.

§1 Allgemeines

§1.1 Gegenstand. Diese Lizenz bezieht sich auf das Paket "Ott-Orgel" und seine Benutzung, wobei das Paket "Ott-Orgel" eine bearbeitete Aufnahme einer Orgel ist, die für die Verwendung mit dem Programm "Hauptwerk" vorbereitet ist und alle seine zusätzlichen Dateien. Im Folgenden wird dieses Paket nur noch "das Paket" genannt werden.

§1.2 Unwirksamkeit einzelner Aussagen. Sollte eine Aussage bzw. ein Paragraph aus dieser Lizenz unwirksam sein, gelten alle anderen Aussagen und Paragraphen gleichwohl.

§1.3 Keine Gewährleistung. Da die Rechte ohne Kosten gewährt werden, besteht keinerlei Anspruch auf Gewährleistung irgendeiner Art. Insbesondere wird nicht garantiert, daß das Paket vollständig, fertig oder zu irgendeinem Zwecke verwendbar ist. Es wird so "wie es ist" zur Verfügung gestellt. Sollten der Lizenznehmer oder Drittte aus irgendeinem Grunde durch dieses Paket finanziellen, körperlichen oder sonstigen Schaden erlangen, oder sollten Daten verloren gehen, liegen die entstandenen Kosten bem Lizenznehmer oder beim Dritten. Der Lizenzgeber stellt dem Lizenznehmer das Paket nach bestem Wissen und Gewissen zur Verfügung.

§1.4 Übersetzungen. Es gilt die deutsche Version der Lizenz. Eine englischsprachige Versionen der Lizenz ist zum einfacheren Verständnis hinzugefügt, hat jedoch keinerlei rechtliche Auswirkungen.

§2 Nutzung

§2.1 Installation auf privaten Rechnern. Der Lizenznehmer darf dieses Paket auf einer beliebig großen Anzahl von privat zugänglichen Computern installieren, wenn das Paket jedes Mal komplett insbesondere mit dieser Lizenzvereinbarung zusammen bleibt.

§2.2 Installation auf öffentlich zugänglichen Rechnern. Der Lizenznehmer darf dieses Paket auf einer beliebig großen Anzahl von öffentlich zugänglichen Computern installieren, wenn das Paket jedes Mal komplett insbesondere mit dieser Lizenzvereinbarung zusammen bleibt, und zusätzlich gewährleistet ist, daß Dritte zum ersten das Paket komplett kopieren können und zum zweiten eindeutig klar ist, daß die zu diesem Paket gehörigen Dateien zusammengehören.

§2.3 Benutzung. Der Lizenznehmer darf dieses Paket dazu nutzen, privat und öffentlich Musikwerke zu spielen. Sollte dabei eine Aufnahme (sei es über die interne Aufnahme-Funktion des Programmes "Hauptwerk" oder extern), so ist dies auch erlaubt. In diesem Fall wird um eine Referenz-Kopie der Aufnahme an den Lizenzgeber gebeten, die jedoch freiwillig ist.

§2.4 Bearbeitung. Der Lizenznehmer darf das Paket nicht verändern. Sollten Fehlerkorrekturen notwendig sein, wird der Lizenzgeber diese in Betracht ziehen und frei entscheiden, ob diese gemacht werden oder nicht.

§2.5 Verwendung von Teilen. Sollte der Lizenznehmer vorhaben, einen Teil des Paketes (z.B. ein Register oder einzelne Pfeifen) in einem anderen Zusammenhang zu stellen (z.B. in einem anderen Paket), so muß er vorher dazu die Erlaubnis des Lizenzgebers haben. In der Regel wird in dem Zusammenhang eine Referenz-Kopie des zu erstellenden Paketes nach Fertigstellung nachzureichen sein.

§3 Weitergabe

§3.1 Erlaubnis der Weitergabe. Dieses Paket darf kostenlos weitergeben werden, wenn erstens die Weitergabe unentgeldlich bzw. gegen eine angemessene Kopiergebühr passiert, wobei dem, dem das Paket weitergegeben wird, klar gemacht werden muß, daß dies Gebühren für das Kopieren und nicht für das Paket an sich sind, und zweitens das Paket komplett und unverändert ist.

§3.2 Lizenz bei Weitergabe. Der, dem das Paket weitergegeben wird, muß die Lizenz des Lizenzgebers akzeptieren, der Lizenznehmer ist hierbei nicht der Lizenzgeber für den, an dem das Paket weitergegeben wird, sondern der ursprüngliche Lizenzgeber.

§3.3 Verbindung mit anderen Produkten. Es ist nicht erlaubt, dieses Paket mit anderen Produkten zusammen zu verkaufen, wenn dieses Paket den Wert des anderen Produkten über Maßen steigert.

§1.1 Matter. This license applies to the package "Ott-Orgel" and its usage, where the package "Ott-Orgel" is a processed recording of an organ which is prepared for the use with the program "Hauptwerk" and all the additional files. In the following the package will be only called "the package".

§1.2 Invalidity of individual declarations. Should a declaration of a paragraph of this license be invalid, all other declarations and paragraphs are still valid.

§1.3 No warranty. Because the rights are offered for no cost there is no right of warranty of any kind. Especially it is not guaranteed that this package is complete, finished or in any way usable. It is provided "as it is". Should the licensee or a third person have any financial, physical or other damage by this package, or should data get lost, the costs are to be carried by the licensee or the third person. The licenser gives the package to the licensee after his best knowledge and conscience.

§1.4 Translations. The German version of the license is valid. An English version of the license is provided to provide an easier understanding, but this translation has no legal consequences.

§2 Usage

§2.1 Installation on private computers. The licensee may install this package on as many private accessible computers as he likes, if each and every time the package is complete with this license.

§2.2 Installation on public accessible computers. The licensee may install this package on as many public accessible computers as he likes, if each and every time the package is complete with this license and in addition it is provided that at first third persons may copy the complete package and at second it is completely clear that all the files of this package belong together.

§2.3 Usage. The licensee may use this package to perform pieces of music privately and publicly. If a recording is made (be it through the internal recording function for the program "Hauptwerk" or externally), this is also allowed. In this case a reference copy of the recording for the licenser is asked for, but voluntarily.

§2.4 Change. The licensee may not change the package. Should error corrections be necessary, the licenser will consider these and decide freely to do them or not.

§2.5 Usage of parts. Should the licensee want to use parts of this package (for example a stop or individual pipes) in another relation (for example in another package), he needs to have the permission of the licenser before doing so. Usually this will require the licensee to send a reference copy of the new package to the licenser after finishing it.

§3 Passing on

§3.1 Permission to pass on. This package may be passed on for no charge, if at first this passing on is for no charge or for a nominal copy fee, where it needs to be made clear to whom the package is passed on that this fee is for copying, and at second this package is complete and unchanged.

§3.2 Licence while passing on. Who gets this package passed on needs to accept the license of the licenser. Who passes the package on is not the new licenser, but the initial licenser.

§3.3 Combination with other products. It is not allowed to sell this package together with other products if this package enhances the value of that product much.

Regarding pipe samples from Joseph Basquin, Jeux d'orgues (Stiehr-Mockers):

The personal use of these soundbanks is free. However, you have to contact me for public or commercial usage, or if you want to publish Jeux d’orgues, or a modified version of Jeux d’orgues, on CDs, Internet, or any other support.

This soundfont still is and will remain free, but don’t forget that most of similar soundbanks are not free, but rather expensive ($50.00 for Sound Canvas Pipe Organ Project, $149.00 or $199.00 for Tascam Gigasound, for example).

This project will only be able to live with your donations (to record new samples for example). Don’t forget to donate (PayPal secured transaction), to make this project live !
